Landlord Rights in the Housing Choice Voucher Program

Landlords have the right to select tenants based on standard rental criteria such as credit history, rental history, and suitability for the property. However, it’s crucial to adhere to fair housing laws that prohibit discrimination based on race, color, national origin, religion, sex, familial status, or disability.

Landlords have the right to receive the fair market rent for their property. The housing authority determines the payment standard for each unit size in a specific area, and the tenant is typically responsible for paying 30% of their income towards rent.

Landlords have the right to maintain their property according to local housing codes. Periodic inspections are conducted to ensure that the property meets HUD’s Housing Quality Standards (HQS). Landlords are notified in advance of inspections, and any required repairs will be communicated with a timeframe for completion.

Landlords have the right to use their standard lease agreement, subject to approval by the housing authority. The lease should comply with local and state laws and cannot contain any provisions that conflict with the HCV program requirements. Lease terms, including rent increases, must comply with program regulations.

Landlords have the right to receive timely and accurate rental payments from the housing authority. Payments are typically made on a monthly basis, and any issues with payments should be promptly reported to the housing authority for resolution.

Landlords have the right to open communication with the housing authority. Whether it’s addressing concerns about a tenant, reporting needed repairs, or discussing program guidelines, maintaining an open line of communication helps ensure a positive and collaborative rental experience.

Landlords have the right to terminate their participation in the HCV program with proper notice. Similarly, the housing authority may terminate a landlord’s participation if there are violations of program rules or failure to meet required standards.
